Short-Term Rentals / Vacation Rentals Specific Terms

These Short-Term Rentals Specific Terms (“Vacation Rental Terms”) supplement and form part of the general Terms of Use for homevind.com (the “Site” or “Platform”). In the event of any conflict, these Vacation Rental Terms prevail solely with respect to properties listed in the “Short-Term Rentals” or “Vacation Rentals” category (the “Vacation Rental Segment”).

  1. Nature of the Service in the Vacation Rental Segment
    The Site operates solely as a neutral advertising and directory platform for short-term rental properties (e.g., vacation homes, holiday lets, weekend getaways) located anywhere in the United States. We provide a space for property owners (“Owners”) to list and promote their properties to potential renters (“Renters” or “Guests”).

We do not facilitate, process, handle, collect, or remit any rental payments, security deposits, fees, taxes, or other charges related to actual rentals.
We do not act as a booking engine, travel agency, property manager, intermediary, or party to any rental transaction in any jurisdiction.
All inquiries, communications, negotiations, agreements, payments, check-ins, stays, cancellations, refunds, and disputes occur directly between the Owner and Renter, without our involvement.

  1. Owner Fees and Listings
    Owners advertising in the Vacation Rental Segment agree to pay a separate advertising/listing fee (as specified in our pricing or account dashboard) solely for display in this category.

This fee is non-refundable (except as explicitly stated in our refund policy) and covers only the listing service. Payment does not guarantee bookings, inquiries, income, visibility, or performance. We may deactivate or remove listings for non-payment or violation of these Terms (including the general Terms of Use). Anti-Circumvention Policy: Any attempt to circumvent Vacation Rental Segment requirements or pricing—such as misrepresenting rental duration, purpose, or category (e.g., listing as long-term while offering short-term use)—is a material breach. We may immediately delete the listing without notice/refund and suspend/terminate the account.

  1. Owner Representations, Warranties, and Responsibilities
    By listing in the Vacation Rental Segment, Owners represent and warrant that:
  • They have the full legal right and authority to offer the property for short-term rental.
  • All listing information (descriptions, photos, availability, rates, house rules, etc.) is accurate, complete, current, and not misleading.
  • They hold and maintain all required licenses, permits, registrations, and approvals in the property’s jurisdiction, including (as applicable) transient/short-term lodging licenses, local registration/permit numbers (e.g., Florida DBPR transient public lodging establishment license under Chapter 509 for rentals <30 days more than 3 times/year or advertised regularly), tax registration for collection/remittance of applicable sales/lodging/tourist taxes, and compliance with zoning ordinances, local short-term rental rules, HOA/condo restrictions, health/safety standards, and any disclosure requirements (e.g., for monitoring devices or material facts).
  • The property and advertising comply with all federal, state, and local laws in the jurisdiction, including fair housing/anti-discrimination rules.

Owners are solely responsible for all aspects of the rental, including bookings, payments, cancellations, refunds, security, cleaning, maintenance, guest interactions, tax obligations, and compliance. Renters are solely responsible for reviewing listings, verifying details (including Owner compliance and any required permit/registration numbers), communicating directly with Owners, and entering agreements at their own risk.

  1. Disclaimers and Limitation of Liability
    TO THE FULLEST EXTENT PERMITTED BY LAW, the Vacation Rental Segment is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind (express or implied), including accuracy, availability, suitability, safety, quality, or compliance of listings/properties.

We expressly disclaim liability for:

  • Any misrepresentation, inaccuracy, omission, or error in listings.
  • Any act, omission, negligence, misconduct, breach, injury, damage, loss, theft, illness, cancellation, dispute, or issue arising from rentals, stays, inquiries, or interactions.
  • Any Owner/Renter failure to comply with laws, licenses, taxes, contracts, or agreements in any jurisdiction.

Under no circumstances shall Homevind.com (or its owners, officers, employees, agents, affiliates) be liable for direct, indirect, incidental, special, consequential, punitive, or reliance damages, even if advised of the possibility. Our aggregate liability (if any) shall not exceed the greater of $100 USD or the fees paid by the relevant Owner in the 12 months preceding the claim.

  1. Hold Harmless and Indemnification
    Owners and Renters each agree to release, indemnify, defend (with counsel reasonably acceptable to us), and hold harmless Homevind.com, its affiliates, officers, directors, employees, agents, and representatives (the “Indemnified Parties”) from any claims, demands, actions, liabilities, losses, damages, costs, expenses (including reasonable attorneys’ fees and court costs) arising from or related to:
  • Any rental transaction, stay, inquiry, or interaction.
  • Misrepresentation, inaccuracy, or omission in listings/communications.
  • Injury, death, property damage, theft, loss, or harm during/related to the rental.
  • Breach of these Terms, violation of laws/regulations/permits/taxes/third-party rights in the property’s jurisdiction (including short-term rental licensing, zoning, tax remittance, or advertising rules).
  • Disputes between Owner/Renter or with third parties (e.g., neighbors, authorities).

This applies regardless of negligence (except gross negligence or willful misconduct by Indemnified Parties) and survives termination.

  1. General Provisions
    These Vacation Rental Terms are governed by Florida law (without regard to conflict of laws principles), except where mandatory provisions of federal law or the consumer protection laws of the Owner’s/Renter’s state of residence or the property’s location apply. Any disputes shall be resolved exclusively through binding arbitration in Port Saint Lucie, Florida, under American Arbitration Association rules (including consumer rules for individuals), with waiver of jury trial and class actions (consistent with the general Terms of Use).

We may modify these Terms at any time; continued use (listing, inquiring, contacting) constitutes acceptance. By listing in the Vacation Rental Segment (as Owner), inquiring/contacting regarding such listings (as Renter), or using the Site for short-term rentals, you acknowledge you have read, understood, and agree to these Vacation Rental Terms (and the general Terms of Use).
