Long-Term / Annual Rentals Specific Terms

These Long-Term / Annual Rentals Specific Terms (“Annual Rental Terms”) supplement and form part of the general Terms and Conditions for Homevind.com (the “Site” or “Platform”). If there is a conflict, these Annual Rental Terms control only for properties listed in the “Long-Term Rentals,” “Annual Leases,” “For Rent by Owner”, or similar category, and for any Property ad offered as a primary residence or for occupancy of thirty (30) days or more (the “Annual Rental Segment”).

1. Nature of the Service

The Site is only a neutral advertising and directory platform. We provide space for private property owners (“Owners” or “Landlords”) to advertise residential properties to potential tenants (“Renters” or “Tenants”).

We do not:

act as a real estate broker, agent, property manager, leasing office, or landlord;
write, review, or broker leases;
process rental applications, screen tenants, or run credit/background checks;
collect, hold, or remit rent, security deposits, last month’s rent, pet deposits, or other tenancy funds;
handle keys, move-in, repairs, notices, or evictions; or
become a party to any lease or tenancy.

All inquiries, negotiations, applications, leases, payments, deposits, occupancy, notices, and disputes occur only between the Owner and the Renter.

2. Who These Terms Are For

These Annual Rental Terms are aimed at private owners advertising their own property for a conventional residential tenancy (for example, a 12-month lease or month-to-month occupancy intended as a home, not a vacation stay).

If you are a licensed agent or broker, the Agent Advertising Agreement also applies. If the stay is short-term or vacation use, the Short-Term Rentals / Vacation Rentals Specific Terms apply instead. Do not use this category to hide short-term use.

3. Owner Fees and Listings

Owners listing in the Annual Rental Segment pay the advertising/listing fee shown at checkout or in the account dashboard. That fee is for display only. It is non-refundable except as required by law or as expressly stated in the general Terms.

Payment does not guarantee inquiries, tenants, occupancy, or any result. We may remove or deactivate a listing for non-payment or violation of these Terms.

Anti-circumvention. Listing a property as an annual / long-term rental while offering or intending short-term or vacation use (or the reverse) is a material breach. We may delete the listing without refund and suspend or terminate the account.

4. Owner Representations and Responsibilities

By listing in the Annual Rental Segment, the Owner represents and warrants that:

the Owner has the legal right and authority to rent the property (including any lender, HOA, condo, or leasehold consent that is required);
all listing information (rent, term, fees, photos, availability, occupancy limits, utilities, pets, parking, and house rules) is accurate, complete, current, and not misleading;
the Owner will comply with all laws that apply where the property is located, including without limitation landlord-tenant, habitability/repair, security-deposit, required disclosures (for example lead-based paint where applicable), registration or licensing if required for long-term rentals, zoning, and Fair Housing / anti-discrimination rules;
the Owner is not using the Site to conduct unlicensed brokerage or to manage rentals for third-party owners unless properly licensed; and
the Owner—not Homevind—is solely responsible for tenant selection, the lease, deposits, rent, repairs, notices, evictions, taxes, and insurance.

5. Renter Acknowledgments

Renters who inquire about Annual Rental Segment listings acknowledge that:

Homevind does not verify ownership, condition, legality, rent amount, or the Owner’s right to rent;
any tenancy is solely with the Owner;
the Renter must do their own due diligence and should not rely on the listing as a substitute for a written lease, inspection, or legal advice; and
Homevind is not responsible for denied applications, deposits lost, uninhabitable units, or disputes with the Owner.

6. Disclaimers and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, the Annual Rental Segment is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, including accuracy, availability, habitability, legality, or suitability of any property or listing.

We are not liable for misstatements in listings; failed or bad tenancies; deposit or rent disputes; injury, damage, or loss at the property; Owner or Renter violations of law; or any lease or eviction issue.

Our aggregate liability related to the Annual Rental Segment, if any, will not exceed the amount the relevant user paid us for the specific Property ad that is the subject of the claim (including any optional upgrade), or $10, whichever is greater. If the listing was free and no upgrade was purchased, our aggregate liability will not exceed $10, except for liability that cannot be limited under applicable law. This limit reflects that the Annual Rental Segment is an advertising listing, which may be free or available with a low-cost optional upgrade, and is not a brokerage, leasing, or property-management service.

7. Indemnification

Owners and Renters each agree to indemnify, defend, and hold harmless Homevind.com and its owners, officers, employees, agents, and affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of:

the listing, inquiry, lease, tenancy, or occupancy;
inaccurate or unlawful listing content;
injury, death, or property damage connected to the rental;
deposit, rent, habitability, Fair Housing, or eviction disputes; or
breach of these Annual Rental Terms or applicable law.

This obligation survives termination of the listing or account.

8. General

These Annual Rental Terms are governed by the same governing-law, venue, and arbitration provisions as the general Terms (Florida law; binding arbitration in Saint Lucie County, Florida; class-action and jury waiver), except where a mandatory consumer-protection law requires otherwise.

We may update these Annual Rental Terms as described in the general Terms. Continued listing or inquiry after a change is acceptance.

By submitting or maintaining a Property ad in the Annual Rental Segment, or by inquiring about such an ad, you agree to these Annual Rental Terms and the general Terms.
